Intrastate
Wisconsin has adopted §390.21 of the Federal Regulations for the marking of intrastate vehicles. Intrastate carriers operating vehicles in Wisconsin meeting the definition of CMV found in §390.5 must be marked with the US DOT number and the legal name of the business entity that owns or controls the motor carrier operation, or the “doing business as” (DBA) name, as it appears on the Form MCS-150.
Qualifying Commercial motor vehicle includes any self-propelled motor vehicle used on a highway in interstate or intrastate commerce to transport passengers or property when the vehicle —
- Has a gross vehicle weight rating or gross combination weight rating, or gross vehicle weight or gross combination weight, of 4,536 kg (10,001 pounds) or more, whichever is greater; or
- Is designed or used to transport more than 8 passengers (including the driver) for compensation; or
- Is designed or used to transport more than 15 passengers, including the driver, and is not used to transport passengers for compensation; or
- Is used in transporting material found by the Secretary of Transportation to be hazardous under 49 U.S.C. 5103 and transported in a quantity requiring placarding under regulations prescribed by the Secretary under 49 CFR, subtitle B, chapter I, subchapter C.
This marking requirement does not apply to:
- A farm or dual purpose farm truck used with a semitrailer or farm trailer; or
- Any vehicle combined with a horse trailer
If —
- The vehicle combination’s gross combination weight rating, registered weight, and actual gross weight do not exceed 26,000 lbs.,
- The combination does not include a commercial motor vehicle described in Wisconsin Statutes:
- Section 340.01(8)(c). (A vehicle designed to transport or actually transporting a driver and 15 or more passengers); or
- Section 340.01(8)(d). (A vehicle transporting hazardous materials requiring placarding or any quantity of a material listed as a select agent or toxin under 42 CFR 73); and
- The vehicle combination is operated solely in intrastate commerce.
US DOT numbers are obtained from the FMCSA.
Interstate
All commercial motor carriers (for-hire and private) operating interstate are subject to the marking requirements of 49 CFR 390.21 which requires all CMVs to display, on both sides of the power unit, the US DOT number and the legal name of the business entity that owns or controls the motor carrier operation, or the “doing business as” (DBA) name, as it appears on the Form MCS-150.
Any new or used commercial vehicles added to a motor carrier’s fleet must be identified with the US DOT number and single trade name before being put into service.
The regulations do not require the MC number or city/state to be displayed on the vehicle.
