Federal regulations
The Washington State Patrol and the Utilities and Transportation Commission have adopted Part 395 of the Federal Regulations.
Applicability
Part 395 applies to vehicles with a gross vehicle weight rating or gross combination weight rating or gross weight or gross combination weight of 10,001 or more pounds and vehicles transporting hazardous materials requiring placards.
Exception — Under the Washington State Patrol requirements, if a company has drivers of commercial motor vehicles of any size hauling logs from the point of production or driving in dump truck operations in intrastate commerce the driver must:
- operate within a 100 air-mile radius of the location where he/she reports for work and return to the work reporting location at the end of each duty tour; and
- have at least 10 consecutive hours off duty separating each on-duty period.
Under this exception, the driver may not drive:
- more than 12 hours following at least 10 hours off duty;
- after the 14th hour after coming on duty on at least five days of any period of 7 consecutive days; and
- after the 16th hour after coming on duty on no more than 2 days of any period of 7 consecutive days.
Under this exception, the driver may not drive after having been on duty for 80 hours in 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week or after having been on duty for 90 hours in 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week. Any period of 7 or 8 consecutive days may end with the beginning of any off-duty period of 24 or more consecutive hours.
Also, under this exception, the motor carrier that employs the driver must retain for 12 months accurate and true time records showing:
- the time the driver reports for duty each day;
- the total number of hours the driver is on duty each day;
- the total number of hours the driver drives each day;
- the time the driver is released from duty each day; and
- the total time the driver is driving and on duty for the preceding 7 days.
Exception — Under the Washington State Patrol’s adoption of §395.1(k), the state’s planting and harvesting season is January 1 to December 31 of each year.
Electronic logging device (ELD)
Washington has adopted the electronic logging device (ELD) requirements in Part 395 for intrastate motor carriers and drivers.
