New York has adopted many federal OSHA standards and incorporates them by reference. New York also has a state law requiring certain construction workers to complete a 10-hour OSHA safety training course.
The state law says that when the contract specifications for a public works project total $250,000 or more, the contract must contain a provision requiring every worker employed in the performance of the contract to be certified as having completed an OSHA 10-hour safety training course prior to performing any work on the contract.
Contractors and subcontractors must attach proof of employees’ completion of the OSHA 10-hour course to the first certified payroll submitted to the contracting agency and on each succeeding payroll where any new employee is first listed. Proof of completion may include:
- Copies of bona fide course completion card.
- Training roster, attendance record, or other documentation from the certified trainer pending the issuance of the card.
- Other valid proof. (A certification by the employer attesting that all employees have completed such a course is not sufficient proof that the course has been completed.)
The OSHA 10 legislation only applies to workers on a public works contract that are required under Article 8 to receive the prevailing wage.
NOTE: Some municipalities (such as New York City) may have stricter requirements. If you are in New York state, be sure to check local requirements for 10-hour and 30-hour OSHA training.
