Overview

Effective November 14, 2008, the Department of Public Safety adopted Parts 40, 382, 385, 387, 390, 391-393, and 395-397, and Appendix F of Subchapter B of Chapter III of the Federal Motor Carrier Safety Regulations as presently in effect including subsequent amendments.

The adopted regulations apply to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.
