North Dakota has adopted Part 391 of the Federal Regulations with some modifications.
Applicability
Part 391 applies to intrastate commercial motor vehicles with a gross vehicle weight, gross vehicle weight rating, gross combination weight, and gross combination weight rating of 26,001 pounds or more, or a vehicle used to transport hazardous materials requiring a placard.
Age
Minimum age for drivers of vehicles in intrastate operations is 18. Younger drivers may drive farm vehicles if certain criteria are followed.
Driver qualification file
A driver qualification file (Sec. 391.51) is required. There is an exception to the physical qualification requirement. See Physical Qualification below for details.
Operator’s license
The classes of driver licenses are:
Class | Description |
---|---|
Class A | Any combination of vehicles with a gross combination weight rating (GCWR) of 26,001 or more pounds, provided the gross vehicle weight rating (GVWR) of the vehicle(s) being towed is in excess of 10,000 pounds. |
Class B | Any single vehicle with a GVWR of 26,001 pounds or more, and any such vehicle towing vehicle(s) not in excess of 10,000 pounds. |
Class C | Any single vehicle less than 26,001 pounds GVWR and must have a P and/or H endorsement. May tow vehicles not in excess of 10,000 pounds. |
Class D | Any single vehicle with a GVWR of 26,000 pounds or less or any such vehicle towing a vehicle with a GVWR not in excess of 10,000 pounds. Must be 18 years of age or under farm exemption if combined weight exceeds 26,000 pounds. May operate a farm tractor towing another vehicle having a gross weight in excess of 10,000 pounds, and may operate a truck towing a trailer in excess of 10,000 pounds provided the combined weight does not exceed 26,000 pounds GCWR. |

Physical qualification
An exemption from the medical standards in Section 391.41(b)(1)-(11) exists for wholly intrastate drivers who are qualified through a state medical waiver program or are otherwise qualified and possessed a Class A license on March 26, 1991. The medical condition must have existed on March 26, 1991, or at the time of the first required physical examination after that date, and determined by a physician to not have substantially worsened since then.
