Missouri is not a state-plan state and therefore follows federal OSHA in most cases regarding worker safety. However, there is a state law that requires OSHA-approved 10-hour safety awareness training for construction workers and supervisors on all public works construction projects in the state.
- All contractors and subcontractors who enter into contracts with public bodies for construction of public works must provide a 10-hour OSHA construction safety and health program for their on-site employees (or a similar program approved by the Missouri Department of Labor and Industrial Relations which is at least as stringent as an approved OSHA program), unless such employees have previously completed the required program.
- Any employees who have not previously completed such a safety program are required to do so within 60 days of beginning work on such construction project.
- Any employee found on a work site subject to this section without documentation of the successful completion of an OSHA 10-hour safety course shall be given 20 days to produce such documentation before being subject to removal from the project.
- It is the employer’s responsibility to make sure all their employees have their program completion cards and turn in proof to the contracting agency before the job starts. The employer can be fined for allowing an employee onsite who does not have a valid OSHA 10-hour completion card.
