Summary of differences between federal and state regulations
Coverage
North Dakota rules determine whether a worker is considered an employee based on a 20-factor test.
Exclusions from the definition of employment include:
- Insurance agents on commission,
- Real estate agents on commission,
- Casual labor not in the course of employers business, and
- Part-time service for nonprofit organizations exempt from federal income tax.
The following student employment is excluded from coverage:
- Student nurses and interns in employ of a hospital, and
- Students working for schools.
North Dakota provisions for officers of corporations exempt corporate officers when one-fourth or more of the ownership interest was owned or controlled by the individual's spouse, child, or parent or by any combination of them if the corporation requests exemption from coverage.
