Kentucky Administrative Regulations incorporate by reference the federal regulations for bloodborne pathogens except the state regulations amend the language of 29 CFR 1910.1030(d)(3)(ix) regarding when gloves must be used.
However, effective June 27, 2025, the Kentucky Revised Statutes prohibit the state from adopting regulations more stringent than the federal OSHA regulations. Therefore, on and after that date, employers must follow the entire federal OSHA standard 29 CFR 1910.1030 as is, including federal OSHA’s gloves provision at 1910.1030(d)(3)(ix).
