In New Jersey, the law states that every trucking industry employer must pay drivers, helpers, loaders, and mechanics for whom the Secretary of Transportation may prescribe maximum hours of work for the safe operation of vehicles pursuant to 49 U.S.C. 31502(b) an overtime rate of not less than 1-1/2 times the required minimum wage.
Types of drivers who are exempt from overtime in New Jersey include employees of a common carrier of passengers by bus, and limousine drivers who are employees of limousine operation businesses.
