In Ohio, a person may not operate a vehicle while using, holding, or physically supporting a cell phone with any part of the person’s body.
This prohibition does not apply to:
- Communication with law enforcement or other emergency services;
- Driving a public safety vehicle during the person’s duties;
- A parked vehicle due to an emergency or road closure;
- Holding the phone directly near the ear for the purpose of making, receiving, or conducting a call (may not manually enter letters, numbers, or symbols into device);
- Receiving wireless messages regarding the operation or navigation of a vehicle; safety-related information, including emergency, traffic, or weather alerts; or data used primarily by the vehicle (may not hold or support the device with any part of the person’s body);
- Using the speaker phone function (may not hold or support the device with any part of the person’s body);
- Navigation purposes (may not manually enter letters, numbers, or symbols or hold or support the phone with any part of the person’s body);
- Using a feature or function with a single touch or single swipe (may not manually enter letters, numbers, or symbols or hold or support the phone with any part of the person’s body);
- Operating a utility service vehicle or a vehicle on behalf of a utility in response to an emergency;
- A voice-operated or hands-free feature or function of the vehicle or of the phone without the use of either hand except to activate, deactivate, or initiate the feature or function with a single touch or swipe (may not hold or support the device with any part of the person’s body);
- Technology that physically or electronically integrates the phone into the motor vehicle (may not manually enter letters, numbers, or symbols or hold or support the phone with any part of the person’s body); or
- Storage of the phone in a holster, harness, or article of clothing on the person’s body.
