Minnesota Occupational Safety and Health Administration (MNOSHA) has adopted most OSHA standards by reference, and includes some additional standards.
High-visibility PPE
Minnesota Admin. Rule 5207.0100 requires that all employees exposed to or working adjacent to moving motor vehicles must be provided with, and required to wear, a high-visibility warning vest or similar garment. The high-vis garment must be Performance Class 2 or greater according to ANSI/ISEA Standard 107-2004. If the garment becomes faded, torn, dirty, or in other ways has its performance compromised, it must be replaced.
Mobile earth-moving equipment
Minnesota Admin Rule 5207.1000 sets forth minimum safety requirements for the operation of equipment used for earth moving, building, or road construction or demolition. Examples include bulldozers, motor graders, compaction equipment, backhoes, and more. Operators and those who work near such equipment must be trained in safe work procedures related to the equipment, and in the recognitions of unsafe conditions. Training must take place before the work begins. The equipment itself must be properly equipped with head and taillights and back-up alarms unless signal persons and other adequate lighting is provided.
Workers who work near such equipment are subject to the high-visibility PPE rule referenced above in 5207.0100.
Minnesota has its own Manual on Uniform Traffic Control Devices for Streets and Highways, but it does not meet or exceed MUTCD 1993 or Millennium criteria, and therefore the federal MUTCD is enforced.
Note that some states have requirements for work zones and flaggers that fall under the state’s Department of Transportation regulations, in addition to the OSHA-related requirements listed here.
