The Oregon Occupational Safety and Health Division (Oregon OSHA) has adopted standards for signs, signals and barricades that go beyond the requirements of federal OSHA 29 CFR 1926 Subpart G. In Oregon, OAR 437-003-0420 applies in place of 1926.200(g)(2), 1926.201, 1926.202 and 1926.203. The regulation reads as follows:
437-003-0420 Traffic Control
- Adequate and appropriate traffic control devices, including signs, signals, markings, and other devices must be provided and used for the protection of workers for all operations on or adjacent to a highway, street, or roadway. The traffic control devices’ design and use must conform to the Manual of Uniform Traffic Control Devices (MUTCD), incorporated by reference in 1926.6.
- Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers, must conform to the Manual of Uniform Traffic Control Devices (MUTCD), incorporated by reference in 1926.6.
- The design and use of barricades for the protection of employees must conform to the Manual of Uniform Traffic Control Devices (MUTCD), incorporated by reference in 1926.6.
OAR 437-003-0134 – Personal Protective Equipment
OAR 437-003-0134(7)(a) applies to PPE in general for construction. Paragraph (7)(a) requires high-visibility garments wherever workers are exposed to hazards from moving vehicles in construction zones. The colors of the garments “must contrast with other colors in the area sufficiently to make the worker standout. Colors equivalent to strong red, strong orange, strong yellow, strong yellow-green or fluorescent versions of these colors are acceptable. During hours of darkness, the garments must also have reflective material visible from all sides for 1000 feet.”

Note that some states have requirements for work zones and flaggers that fall under the state’s Department of Transportation regulations, in addition to the OSHA-related requirements listed here.
