In Alabama, a person commits a violation of operating a vehicle in a distracted manner if observed crossing in and out of a traffic lane without using a turn signal, swerving, or otherwise operating the vehicle in an impaired manner while:
- Physically holding a phone,
- Watching a video or movie on a phone,
- Recording or broadcasting a video on a phone,
- Using more than a single button or swipe of a finger on a phone to initiate or terminate a voice-communication, or
- Reaching for a phone so that they are no longer in a seated driving position properly restrained by a safety belt.
These prohibitions do not apply when:
- Communicating with law enforcement or other emergency services;
- Used by law enforcement or other emergency services personnel;
- The vehicle is parked;
- Used to obtain driving directions;
- Using an earpiece, headphones, steering wheel controls, speaker phone, voice-activated technology, or other device worn on the person or mounted on the vehicle to conduct hands-free voice communication;
- Used by an employee or contractor of a utility services provider when responding to an emergency or performing other critical services;
- Used in a manner that requires the physical use of the person’s hand while operating a vehicle if:
- The phone is mounted to the vehicle and the device does not create an unsafe obstruction of the view of the road, and
- The person’s hand is used to activate or deactivate a feature of the phone with one swipe or tap of a finger.
