Under Colorado state law, truck drivers are exempt from overtime pay rules when they meet all the following conditions:
- They are drivers or driver’s helpers subject to the Federal Motor Carrier Act (MCA), and exempt from Federal Labor Standards Act overtime requirements;
- They are working on MCA-covered non-passenger vehicles, or on MCA-covered vehicles that qualify as commercial motor vehicles that require a commercial driver’s license to operate (with exceptions for certain vehicles that transport workers to and from manual work jobs, and do not require a CDL);
- They are paid compensation equivalent to at least 50 hours of work at Colorado minimum wage plus overtime (as of January 2024, no less than $793.10/week), regardless of how that pay is made (salary, hourly, piece rate, etc.)
