South Dakota incorporates by reference the federal regulations for Non-Hazardous Solid Waste and Recycling; however, the state adds further requirements.
A summary of the additional requirements includes the following:
- The DANR offers a waste pesticide disposal and pesticide container recycling program pursuant to SDCL 38:20A:54. All eligible waste pesticides are based on the toxicity of the pesticide, condition of the container, and the potential for the pesticide to harm human health or the environment.
- DANR does not require a license or permit to transport cannabis waste. However, cannabis waste hauled offsite must be transported to a landfill facility permitted to accept the waste for disposal or composting.
- The solid waste administrative rules (ARSD 74:27:13:17) require that medical/infectious waste must be rendered non-infectious by incineration, steam sterilization, chemical disinfectant, or equally effective treatment method, prior to disposal in a municipal solid waste landfill.
