Indiana incorporates by reference the federal regulations for Non-Hazardous Solid Waste and Recycling; however, the state adds further requirements.
A summary of the additional requirements includes the following:
- Uncontaminated rocks, bricks, concrete, road demolition debris, and dirt are not subject to solid waste regulations (329 IAC 10-3-1 (1)), and therefore do not have to be disposed in a landfill. Uncontaminated, untreated, and unpainted dimensional lumber similar to natural growth solid waste is also not subject to regulation as a solid waste (329 IAC 10-3-1 (2)). Such debris may be left or buried on-site, or may be used off-site as fill, so long as such activity complies with local and other state and federal regulations.
- Industrial solid waste generators who intend to dispose of industrial solid waste at a restricted waste site must sample and analyze their waste to determine chemical concentration levels and if their waste is not hazardous waste. If the waste is determined to be nonhazardous waste, they must obtain a waste classification from IDEM to determine if the waste can be disposed of at a restricted waste site, unless the waste is disposed at a state permitted municipal or non-municipal solid waste landfill. Waste must be characterized at the point of generation of each waste stream to determine the waste classification type before disposing of it in a restricted waste site.
- A MSW landfill can accept non-hazardous non-MSW waste, unless prohibited by 329 IAC 10-9-2(b). Waste that is not created by community activities or residential/commercial establishments are non-municipal solid waste. This could also include solid waste generated by industries.
