New York has adopted many federal OSHA standards and incorporates them by reference. The New York Public Employee Safety and Health (PESH) Bureau plan applies to state and local government workers in the state. Federal and private sector employers must follow federal OSHA standards.
PESH has no additional heat injury and illness prevention regulations; however, it has adopted OSHA’s Heat National Emphasis Program (NEP) to help employers identify and reduce exposure to heat-related injury and illness. PESH has made alterations to cover appropriate public sector industries and to consider available resources. The list of covered industries includes:
