Summary of differences between federal and state regulations
Montana law covers all employers who provide coverage under group disability insurance. Plan participants may continue coverage for a period of one year, with the consent of the employer, during their employment notwithstanding any reduction of his regular work schedule to less than the minimum time required to qualify for membership in the group, and the premium charged them shall be equal to that charged other members of the group of the same risk class.
Plan participants must have been insured for a period of three months. Plan participants are entitled to have issued group disability coverage or an individual disability policy.
Group disability policies covering expenses of hospital, nursing, medical, or surgical services for members of the family or dependents may provide for the continuation of such coverage after the death of the plan participant.
There are also laws on certificates of creditable coverage.
