The Ohio Minimum Fair Wage Standards Act (MFWSA) states that the definition of “employee” and “independent contractor” have the same meaning as under the FLSA. Therefore, the factors that FLSA relies on to determine employee vs. independent contractor, and the protections due to each, are the same as would apply under Ohio law.
