North Carolina state wage law excludes, but does not define, independent contractors from employment protections granted to employees. North Carolina courts apply a common-law right-to-control test in determining whether an individual is an employee, considering factors such as:
- The degree of control the alleged employer exerted over the person; and
- The permanency of the relationship between the person and the employer.
Employee: Any individual employed by an employer.
