Summary of differences between federal and state regulations
The federal Fair Labor Standards Act contains certain provisions in regard to compensation in terms of minimum wage, overtime, child labor and recordkeeping requirements. Corresponding state provisions will be found under those topic areas. States are free to adopt additional provisions that are not regulated by the federal government such as frequency of payday and wage deductions. These provisions are discussed in this section.
Frequency of payday
Employers shall establish a regular payday not to exceed 35 days in length. Paydays may be at more frequent intervals. An employer may enter into a written agreement with his employees for different conditions of payment that are mutually satisfactory. §652.120
Authorized deductions
Deductions are prohibited unless required by law, collective bargaining agreement, or authorized in writing by the employee, are for the employee’s benefit and recorded in the employer’s books. Employers must provide itemized statements of deductions to employees each payday. It may be part of the check or another written document. §652.610
Deduction for medical exam
An employer may not take a deduction for a medical exam or for the cost of providing a health certificate required by the employer. §659A.306
