Texas has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through September 1, 2022.
Part 393 applies to a vehicle or combination of vehicles with an actual gross weight or a gross weight rating in excess of 26,000 pounds when operating intrastate, and a vehicle of any size hauling hazardous materials requiring placarding.
| Brakes | Texas Transportation Code, 547.401 and 547.404, concerning brakes on trailers weighing 15,000 lbs. gross weight or less, take precedence over the brake requirements in the federal regulations for trailers of this gross weight specification unless the vehicle is required to meet the requirements of 571.121 of the federal regulations, applicable to the vehicle at the time it was manufactured. |
| First Aid Kit | No requirements |
| Mudflaps | A road tractor, truck, trailer, truck-tractor in combination with a semitrailer, or semitrailer in combination with a towing vehicle that has at least four tires or at least two super single tires on the rearmost axle of the vehicle or the rearmost vehicle in the combination must be equipped with safety guards or flaps that are of a type prescribed by the Texas Department of Public Safety. The safety guards or flaps must be located and suspended behind the rearmost wheels of the vehicle or the rearmost vehicle in the combination within eight inches of the surface of the highway. This requirement does not apply to a truck-tractor operated alone or a pole trailer. |
| Tires | Studded Tires - No tire may have a block, stud, flange, cleat, spike or any other protuberance of a material other than rubber projecting beyond the tread surface of the tire. |
| Tire Chains - A tire chain of reasonable size that is used as required for safety because of a condition that might cause the vehicle to skid is allowed. |
