North Dakota has adopted Part 396 of the Federal Motor Carrier Safety Regulations (FMCSRs), and amendments as they occur.

Part 396 applies to intrastate commercial motor vehicles with a gross vehicle weight, gross vehicle weight rating, gross combination weight, and gross combination weight rating of 26,001 pounds or more, or a vehicle used to transport hazardous materials requiring a placard.
