New Mexico has adopted Part 396 of the Federal Motor Carrier Safety Regulations (FMCSRs), including subsequent amendments.

Part 396 applies to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.
