Nebraska has adopted Part 396 of the Federal Motor Carrier Safety Regulations (FMCSRs), as they existed on January 1, 2026.

Part 396 applies to all intrastate motor carriers and all vehicles of intrastate motor carriers with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight over 10,000 pounds, and to all intrastate motor carriers operating vehicles transporting a placardable amount of hazardous materials.

Exception: Section 396.11 does not apply to drivers of farm trucks registered pursuant to 60-3, 146 and operated solely in intrastate commerce.

Exception: Part 396 does not apply to the operation of a covered farm vehicle.
