Montana has adopted Part 396 of the Federal Motor Carrier Safety Regulations (FMCSRs), as updated through March 26, 2025.

Part 396 applies to commercial motor vehicles operated in intrastate commerce which have a gross vehicle weight rating or gross combination weight rating of 26,001 pounds or more, or vehicles transporting hazardous materials.

Exception: Part 396 does not apply to the operation of a covered farm vehicle.
