Minnesota has adopted Part 396 of the Federal Motor Carrier Safety Regulations (FMCSRs) with the exception of 396.9, 396.11(d), 396.17, 396.19, 396.21, and 396.23.

Part 396 applies to motor vehicles that have a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 10,001 pounds or more, or hauling hazardous materials required to be placarded.

Exception: The operator of a “covered farm vehicle” as defined in 390.5 is exempt from the vehicle inspection requirements in Part 396. This exception does not apply if transporting a placardable amount of hazardous materials.

Exception: Part 396 does not apply to an individual operating a pipeline welding truck.

Annual Inspections - Motor Carrier An annual inspection must be done on commercial motor vehicles registered in Minnesota. A commercial motor vehicle includes:
  • A motor vehicle having a GVW > 26,000 pounds;
  • Each vehicle in a combination > 26,000 pounds; and
  • Any size vehicle transporting hazardous materials that are required to be placarded.

It is unlawful for a person to operate a commercial motor vehicle unless the vehicle displays an inspection decal issued by a certified inspector or the vehicle carries:
  • Proof that the vehicle complies with federal motor vehicle inspection requirements for vehicles in interstate commerce; and
  • A certificate of compliance with federal requirements issued by the commissioner.

The inspector must be:
  • An owner or an employee of a motor carrier having one or more power units;
  • A dealer buying and selling commercial motor vehicles;
  • A person engaged in the business of repairing and servicing commercial motor vehicles; or
  • Employed by a governmental agency that owns commercial motor vehicles.

The certification of a private inspector will be valid for two years. A private inspector may charge a reasonable fee. An inspection report must be prepared and a decal must be issued.
This mandatory inspection program is considered equivalent to the Federal annual inspection requirement in Part 396.
