Idaho has adopted Part 396 of the Federal Motor Carrier Safety Regulations, as published and annually recompiled.
Part 396 applies to intrastate carriers operating commercial motor vehicles transporting property with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating greater than 26,000 pounds, and intrastate carriers transporting placardable quantities of hazardous material subject to the authority of the Idaho State Police.
Exception: Intrastate carriers operating commercial motor vehicles transporting property with a GVWR, GCWR, GVW, or GCW greater than 10,000 lbs. and up to 26,000 lbs., subject to the authority of the Idaho State Police, must comply with 396.1, 396.3(a), (a)(1), and (a)(2), and 396.5 through 396.9.
