Delaware has adopted Part 396 of the Federal Motor Carrier Safety Regulations (FMCSRs), with future amendments.
Part 396 applies to a single vehicle or a vehicle in combination operated in intrastate commerce with a gross vehicle weight rating or gross vehicle weight over 26,000 pounds, and any size vehicle hauling hazardous materials requiring placards.
| Annual Inspections - Motor Carrier | Prior to registration, registration renewal, or reregistration, every motor vehicle to be operated on highways of Delaware must be inspected by the Division of Motor Vehicles. The official state inspection does not replace the Federal Periodic Inspection required by 396.17. The official state inspection is not required for vehicles registered under the International Registration Plan (IRP) as long as a valid federal periodic inspection certificate is presented at the time of vehicle registration. The above inspection requirement may be waived for fleets of 15 or more vehicles provided there are adequate inspection and maintenance facilities at the fleet head-quarters. Approval must be granted. |
