In California, a person may not drive a vehicle while using a phone unless it is specifically designed and configured to allow hands-free listening and talking and is used in that manner while driving.
This prohibition does not apply to:
- Communication with law enforcement or other emergency services,
- Law enforcement or other emergency services personnel,
- Driving a school bus or transit vehicle, or
- Driving a motor vehicle on private property.
A handheld phone may be operated with the use of the driver’s hand if:
- The phone is mounted on a vehicle’s windshield in the same manner as a portable global positioning system or is mounted on a vehicle’s dashboard or center console in a manner that does not hinder the driver’s view of the road, and
- The driver’s hand is used to activate or deactivate the phone with the motion of a single swipe or tap of the finger.
