Cargo loading and securement - South Carolina
South Carolina has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs).
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to a commercial motor vehicle and its driver, operating in intrastate commerce with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating equal to or exceeding 26,001 pounds, or a commercial motor vehicle and its driver, transporting hazardous materials required to be placarded.
In South Carolina, a vehicle must be constructed or loaded to prevent any of its load from dropping, sifting, leaking, or otherwise escaping from the vehicle.
This requirement does not apply to a public authority with jurisdiction:
- Dropping sand, salt, or other chemicals for traction; or
- Sprinkling water or other substances to clean or maintain the roadway.
When loaded with rock, gravel, stone, or substances which could blow, leak, sift, or drop, the vehicle must not be driven unless the height of the load against all four walls does not extend above a horizontal line six inches below the vehicle’s top.
A load that exceeds the height limit must be covered with a tarpaulin or other suitable covering, unless the vehicle is constructed to prevent any of its load from dropping, sifting, leaking, blowing, or otherwise escaping from the vehicle.
