New York has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), revised as of October 1, 2022.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
In New York, the operation of any open truck or trailer being utilized for the transportation of any loose substances on a public highway is unlawful unless the vehicle has a cover, tarpaulin, or other device of a type and specification approved by the Commissioner of Transportation which completely closes in the opening to prevent the falling of any loose substances.
If the load is arranged so that no loose substance can fall from or blow out of the open truck or trailer, the covering is unnecessary.
