New Mexico has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), including subsequent amendments.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to intrastate vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds (whichever is greater), and any vehicle transporting hazardous materials requiring placarding.
In New Mexico, no vehicle may be driven or moved on any highway unless the vehicle is constructed, loaded, secured, or covered to prevent any of its load from dropping, sifting, leaking, or otherwise escaping.
No person may operate on any highway any vehicle or combination of vehicles with any load unless the load and any covering are securely fastened to prevent the covering or load from becoming loose, detached, or in any manner a hazard to other users of the highway.
This requirement does not apply to the following:
- The dropping of sand for the purpose of securing traction, or
- The sprinkling of water or other substances for cleaning or maintaining the roadway.
