New Jersey has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), including all amendments.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to an intrastate vehicle with a gross vehicle weight, gross vehicle weight rating, gross combination weight, gross combination weight rating, or registered weight of 10,001 pounds or more, or a vehicle of any size transporting a placardable amount of hazardous materials.
In New Jersey, no person may cause or permit a vehicle to be loaded or operated so that the contents may be scattered in any street.
Whenever the load of any vehicle is of material other than farm products susceptible to scattering on a street and the load extends above the height of the sides or tail gate or rear of the body of the vehicle, the load must be securely covered by a tarpaulin or other cover.
