Kentucky has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs).
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to for-hire and private vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or transporting hazardous materials which require placarding.
In Kentucky, vehicles must not be operated upon any highway unless they are constructed to prevent their contents from escaping.
In addition, no vehicle may be operated on any public highway for over one mile, if its load is susceptible to shifting or spillage, unless the load is covered with a device suitable for prevention of spillage.
