Cargo loading and securement - Iowa
Iowa has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), as it existed on October 1, 2023.
The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to commercial vehicles with a gross weight or combined gross weight of 10,001 or more pounds, as well as to commercial vehicles with a gross vehicle weight rating or gross combination weight rating of 10,001 or more pounds. Vehicles transporting hazardous materials requiring placarding are also subject.
Part 393 does not apply to combination vehicles provided the gross vehicle weight rating of the power unit is 10,000 pounds or less and the gross combination weight rating is 26,000 pounds or less.
In Iowa, vehicles must not be driven or moved on any highway by any person unless the vehicle is constructed or loaded, or the load securely covered, to prevent:
- Any of the load from dropping, sifting, leaking, or otherwise escaping; or
- The load covering from dropping from the vehicle.
This requirement does not apply to:
- The dropping of sand for the purpose of securing traction,
- The sprinkling of water or other substances to clean or maintain the roadway, or
- Vehicles loaded with hay or stover or the raw farm products listed in Iowa Code 321.466, subsections 4 and 5.
