Indiana has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs). The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to for-hire carriers operating motor vehicles exclusively in intrastate commerce that have a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 10,001 pounds or more.
Part 393 applies to private carriers operating motor vehicles exclusively in intrastate commerce that have a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating of 26,001 pounds or more.
Part 393 applies to any size vehicle (for-hire or private) transporting a placardable amount of hazardous materials.
In Indiana, vehicles may not be driven or moved on a highway if their contents are dripping, sifting, leaking, or otherwise escaping from the vehicle.
This requirement does not apply to:
- A vehicle containing poultry or livestock being transported to market, or
- A highway maintenance vehicle engaged in spreading sand or deicing chemicals.
All vehicle loads hauled over port roads must be properly covered and adequately secured.
