Cargo loading and securement - Georgia
Georgia has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), with subsequent amendments. The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to any self-propelled or towed motor vehicle used on a highway in intrastate and interstate commerce when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.
In Georgia, a vehicle must not be driven or moved on any public road unless it is constructed, loaded, or covered to prevent any of its load from dropping, escaping, or shifting to:
- Create a safety hazard, or
- Deposit litter on public or private property while the vehicle is on a public road.
However, the spreading of any substance in public road maintenance or construction operations is permitted.
Individuals may not operate or load for operation, on any public road, any vehicle with any load unless the load and its covering are securely fastened to prevent the covering or load from:
- Becoming loose, detached, or in any manner becoming a hazard to other users of the public road; or
- Depositing litter on public or private property while the vehicle is on a public road.
Motor carriers must not allow a commercial motor vehicle to be driven or operated with a load that is not secure. All loads must be secured as required by state and federal law, rule, and regulation.
No person may operate any motor vehicle with a load on or in such vehicle unless the load on or in the vehicle is adequately secured to prevent the dropping or shifting of such load onto the roadway in such a manner as to create a safety hazard.
