Delaware has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), with future amendments. The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to a single vehicle or a vehicle in combination operated in intrastate commerce with a gross vehicle weight rating or gross vehicle weight over 26,000 pounds, and any size vehicle hauling hazardous materials requiring placards.
In Delaware, a vehicle must be constructed or loaded to prevent its contents from dropping, sifting, leaking, or otherwise escaping from the vehicle.
