Cargo loading and securement - Colorado
Colorado has adopted Part 393 of the Federal Motor Carrier Safety Regulations (FMCSRs), as in effect on October 1, 2025. The adoption includes regulations dealing with projecting loads (393.87) and cargo securement (Part 393, Subpart I).
Part 393 applies to a self-propelled or towed vehicle bearing an apportioned plate or having a manufacturer’s gross vehicle weight rating or gross combination rating of at least 16,001 pounds. Part 393 also applies to a vehicle used on a public highway to transport a placardable amount of hazardous materials.
Vehicles with a manufacturer’s gross vehicle weight rating or gross combination rating of 10,001 pounds to 16,000 pounds must comply with the load securement requirements (Part 393, Subpart I) and coupling device requirements (Part 393, Subpart F).
In Colorado, a vehicle must be constructed or loaded, or a load securely covered to prevent any of its load from blowing, dropping, sifting, leaking, or otherwise escaping.
This requirement does not apply to:
- The dropping of material to secure traction, or
- The sprinkling of water or another substance to clean or maintain the roadway.
No vehicle may be driven or moved for more than two miles if the vehicle is transporting aggregate material with a diameter of one inch or less unless the load is covered by a tarp or in another manner or utilizes other technology that prevents the aggregate material from blowing, dropping, sifting, leaking, or otherwise escaping from the vehicle. These aggregate material requirements do not apply to a vehicle:
- Operating entirely within a marked construction zone,
- Involved in maintenance of public roads during snow or ice removal operations, or
- Involved in emergency operations when requested by a law enforcement agency or an emergency response authority designated by or pursuant to Colorado Revised Statutes 29-22-102.
