Yes, employers do have a right to refuse entry without a warrant, under the fourth amendment to the U.S. Constitution. However, employers must recognize that it is relatively quick and easy for OSHA Compliance Safety and Health Officers (CSHO) to obtain a warrant. And, in cases where OSHA expects an employer will refuse entry, the Agency may request a warrant prior to showing up at the employer’s worksite for the inspection.
