No, FMCSA guidance to 382.601 indicates motor carriers are only required to provide the policy to drivers prior to participating in the Part 382 program. However, if you dramatically changed the policy and place additional expectations on the drivers, it is advised that you provide at least a copy of an addendum of the changes to existing drivers. For instance, suppose a motor carrier decides to start retesting after all negative dilute post-accident drug tests when the medical review officer is not mandating a test. The driver should know that the company has elected to implement this optional provision in its policy. This may help avoid any inadvertent refusals to test.
