Any motor carrier operating in U.S. commerce is subject to the Federal Motor Carrier Safety Regulations (FMCSRs), the same as its U.S. counterparts.
A driver is performing a safety-sensitive function if operating a commercial motor vehicle requiring a commercial driver’s license as required by:
- The Licencia Federal de Conductor (Mexico); or
- The Canadian National Safety Code.
Only drivers operating in U.S. commerce are subject to the FMCSRs. Any drivers operating solely in Canada or Mexico, respectively, are not to be included in the carrier’s FMCSA drug and alcohol testing program.
