Summary of differences between federal and state regulations
There is no one federal law that specifically addresses employment applications, although there are record retention guidelines under a variety of federal laws (see the Recordkeeping topic) and non-discrimination provisions for hiring in general (see the Discrimination topic).
The Iowa Administrative Code states that an employer may inquire on a job application about an applicant’s age, provided that the inquiry is made in good faith and not for a discriminatory purpose. Any preference must be based on a bona fide occupational qualification. IAC 161-8.15(5).Similar provisions relating to inquiries in regard to disabilities and gender are found in 161-8.31(216) and 161-8.8.50(216) respectively.
