Summary of differences between federal and state regulations
There is no one federal law that specifically addresses employment applications, although there are record retention guidelines under a variety of federal laws (see the Recordkeeping topic) and non-discrimination provisions for hiring in general (see the Discrimination topic).
Delaware law prohibits employers from inquiring into criminal records that have been expunged.
Salary history
Delaware law also prohibits employers from asking for salary history information from job applicants. An applicant could volunteer prior compensation information (though it still may not be solicited by the employer). An employer may request salary history information after an offer of employment (including the terms of compensation) has been extended. At that point, the information may be used for confirmation purposes only (it should not be used to negotiate down the offered compensation package).
