Summary of differences between federal and state regulations
Employer defined
“Employer” means a person having in her or his employ 20 or more employees for each working day in each of twenty or more calendar weeks in the current or preceding calendar year, and any person acting for or in the interest of an employer, directly or indirectly. The term does not include:
- the United States,
- a corporation wholly owned by the government of the United States, or
- an Indian tribe.
Unlawful employment practices
The unlawful employment practices and exemptions are similar to those under the federal Age Discrimination in Employment Act. For example, the state law includes an exemption for a seniority or merit system. A charge must be filed within 300 days of the alleged violation.
