Summary of differences between federal and state regulations
Employer defined
The state law only applies to public employers, defined as any agency, department, board, commission, bureau, council, institution, or other entity of the state supported by appropriation of state or federal funds, or any county or municipality or other political subdivision of this state. “Public employer” specifically includes public universities, colleges, and public school districts.
Unlawful employment practices
The unlawful employment practices and exemptions are similar to those under the federal Age Discrimination in Employment Act. For instance, the state law includes an exemption for a bona fide occupational qualification.
Recordkeeping
Employers must keep records of the name, address, and occupation of each employee, the daily and weekly hours worked by each person, and of the wages paid each pay period. Covered employers must maintain records of the salaries and wage rates, job classifications, and other terms and conditions of employment for each employee. These records must be preserved for three years.
