South Dakota has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through January 1, 2026.
Section 390.15 includes accident recordkeeping requirements.
Section 390.15 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.
Accident reporting - Motor carrier
| Notification | Local law enforcement must be notified when the accident resulted in:- Death
- Injury or
- Property damage:
- ≥ $1,000 to one person’s property or
- ≥$2,000 per accident

Obtaining an accident report
| Procedure | A copy of an official accident report may be obtained by completing an “Accident Report Request” form.

| Fee | $4.00 for each report. There is a $6.00 convenience fee to purchase a report online. |
