South Dakota has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), as amended through January 1, 2024.
Note: Effective July 1, 2025, South Dakota has adopted 390.15 of the FMCSRs, as amended through January 1, 2025.
Section 390.15 includes accident recordkeeping requirements.
Section 390.15 applies to drivers and motor carriers operating intrastate vehicles and combinations of vehicles with three or more axles or with a gross vehicle weight rating of 26,001 or more pounds, and any size or type of vehicle used to transport hazardous materials requiring placarding.

Obtaining an accident report
Procedure | A copy of an official accident report may be obtained by completing an “Accident Report Request” form. The form is available via the South Dakota Office of Highway Safety website: http://safesd.gov. An accident report may also be obtained electronically via the same website. |
Fee | $4.00 for each report. There is a $6.00 convenience fee to purchase a report online. |
