South Carolina has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs). Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to a commercial motor vehicle and its driver, operating in intrastate commerce with a gross vehicle weight, gross vehicle weight rating, gross combination weight, or gross combination weight rating equal to or exceeding 26,001 pounds, or a commercial motor vehicle and its driver, transporting hazardous materials required to be placarded.

Accident reporting - Motor carrier

Notification

The operator or owner of a motor vehicle involved in an accident must forward a written report and verification of liability insurance coverage of such accident to the department if the accident resulted in:

Death
Injury or
Property damage ≥ $1,000

The “Traffic Collision Report” form (FR-309) must be used to compete the reporting and verification process. The form is available via the South Carolina Department of Motor Vehicles website:

Reporting Timeframe

15 days (Not required if accident investigated by law enforcement.)

Obtaining an accident report

Procedure	A copy of an official investigating officer’s motor vehicle accident report may be obtained online or by submitting Form FR-50 to the Department of Motor Vehicles. Form FR-50 may be obtained via the SCDMV website: http://www.scdmvonline.com/Forms-And-Manuals. A report may be obtained online at: https://www.scdmvonline.com/Vehicle-Owners/Collision-Reports.
