Oregon has adopted 390.15 of the Federal Motor Carrier Safety Regulations (FMCSRs), in effect on April 1, 2025. Section 390.15 includes accident recordkeeping requirements.

Section 390.15 applies to intrastate and interstate operations when the vehicle has a gross vehicle weight rating, gross combination weight rating, gross vehicle weight, or gross combination weight of 10,001 pounds or more, or is of any size transporting a placardable amount of hazardous materials.

Accident reporting - Motor carrier

Notification Form 735-32 must be filed with Oregon DMV within 72 hours when:
  • Damage to the vehicle you were driving is > $2,500;
  • Damage to any vehicle is > $2,500 and any vehicle is towed from the scene as a result of damages from this accident;
  • Injury or death resulted from this accident, or
  • Damages to any one person’s property other than a vehicle involved in this accident is > $2,500.

When an accident involving a fatality occurs, the motor carrier must notify Oregon DOT within 24 hours of learning of the fatality.
The motor carrier must submit Form 735-9229 (Motor Carrier Crash Report) with Form 735-32 (Oregon Traffic Accident and Insurance Report). Form 735-9229 is required when a fatality occurs within 30 days of the accident, any person involved sustains injury requiring treatment away from the scene, or any vehicle involved requires towing.
Reporting Timeframe
  • 72 hrs. to file Form 735-32
  • 24 hrs. by phone ((503) 986-3507) when fatality occurs
  • 30 days to file Form 735-9229

Obtaining an accident report

Procedure Copies of an individual’s Oregon Traffic Accident and Insurance Report are not available. Information contained in the report, including the identity of the owner, driver, occupants, vehicle registration number, insurance information, and the names of witnesses are available to any person involved in the accident, the person’s family, or the person’s personal representative.
A Certificate of Filing is available at no charge to those persons who have, or claim to have, filed an Oregon Traffic Accident and Insurance Report with the Department of Motor Vehicles.
